GlowSync Terms of Service

Welcome to GlowSync. These Terms of Service ("Terms") are an agreement between you and Bronze Cut Studio, Inc. ("GlowSync", "we", "us"). They cover the GlowSync app, GlowSync Premium and our website glowsync.me. By creating an account, joining a shared edit or otherwise using GlowSync, you agree to these Terms. Our Privacy Policy (https://glowsync.me/privacy-policy) explains how we handle your information.

In short: You keep ownership of your photos. GlowSync analyzes and edits photos on your device. In a shared edit, each person retouches only their own face and chooses the look of their own copy of the finished photos. Only share photos of people who are happy to be in them. Premium renews through Apple until you cancel, and once you've finished signing up you can delete your account in the app at any time.

1. Who can use GlowSync

You must be at least 13 years old, or older if the law where you live sets a higher minimum age.
If you're under 18, or under the age of majority where you live, you need your parent's or guardian's permission to use GlowSync. Where a law requires a parent's or guardian's consent through the App Store, these Terms apply to a minor only with that consent.
You can't use GlowSync if the law prohibits you from doing so.

2. Your account

You sign in with Apple, Google or your e-mail address, and you verify a phone number that you are entitled to use. Give us accurate information and keep your sign-in secure. You're responsible for what happens under your account. If you think someone else is using it, tell us at support@glowsync.me.
Other people on GlowSync can see your username and profile photo, and can find you by your username or, if they have it in their contacts, your phone number (unless you object to that; see the Privacy Policy, section 12). Don't choose a username or profile photo that pretends to be someone else or that infringes someone's rights.
You can join a shared edit you're invited to without an account, as a guest. Guest accounts are deleted automatically after a period without use, as the Privacy Policy explains.
Once you've finished signing up, you can delete your account at any time in Profile › Account › Delete account. If you didn't finish signing up, write to us at support@glowsync.me and we'll delete it.

3. Your content

It's yours. You keep ownership of the photos, edits and other content you add to GlowSync ("your content").
What you let us do with it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your content, only as needed to operate GlowSync for you and for the people you choose to edit with. For example, we store a shared edit's photos, show them to its members and, as section 4 explains, show up to six of them to people who open its invitation in the app, deliver the finished photos, keep GlowSync secure and make backups. We don't use your content for advertising, and your photos aren't used to train AI models. While Style learning is on for your account, you also let us use the settings and steps of the edits you finish and the descriptions of their photos that your iPhone makes, never the photos themselves, to train and improve GlowSync's AI and editing tools, as the Privacy Policy explains in section 3.13. You can turn it off at any time in Profile › Personalization; we then delete what we kept.
When the license ends. The license ends when your content is deleted from our systems, except for the finished photos of shared edits you took part in, which stay with the edit's host, and copies other people already saved. Backup copies are deleted automatically within 40 days. A style model or profile made for you alone is deleted when you turn Style learning off or delete your account; AI models trained on many people's records keep what they learned, and they don't contain your photos.
Shared edits. When you take part in a shared edit, you agree that its members can see its photos and everyone's edits, and can save, keep and share the finished photos, including your edits.
Your responsibility. You're responsible for your content and for having the rights to use it. You're responsible for making sure you have permission to edit and share photos of other people who appear in them.
Keep your own copies. GlowSync isn't a backup service. Save the photos you want to keep to your Photos library.

4. Shared edits

The host's promise. When you start a shared edit, you confirm you have the right to use the photos and that the people shown in them have agreed to be in it. For a child, that means a parent or guardian has agreed.
Everyone retouches their own face. Each person who joins picks the face that's theirs, and their retouching applies only to that face. Only pick your own face. Each person, the host included, also chooses the look of their own copy of the finished photos: its filter, adjustments and crop, and any objects removed. That look applies only to their copy.
The host is in charge. Only the host creates invitations. The host can replace a link, pause new people from joining, remove people, extend the deadline and finish the edit, including without people who haven't finished.
Invitations. Anyone with an invitation link can open it. In the app they can see the host's name, username and profile photo, up to six of the edit's photos and who else is in it or has been invited in the app; while the host has paused new people from joining, they don't see the photos. On glowsync.me, a link shows the host's name and how many photos there are. People invited in the app can be seen by others who open that edit's invitation. Share links only with people you want in the edit.
Finished photos. Every member can save the finished photos. Deleting can't reach copies someone already saved — for example, a finished photo a member saved to their Photos library or shared elsewhere. The finished photos stay with the host for as long as the host's account exists, even if you delete your account. If the host deletes their account, the shared edit ends and its photos, including the finished photos, are deleted for everyone.

5. Faces and AI

AI-powered editing. GlowSync analyzes and edits photos on your device. GlowSync's tools enhance, retouch and beautify photos based on the edits you choose, and your photos aren't used to train AI models. Style learning uses how you edit, the descriptions of your photos that your iPhone makes, the looks you mark as favorites and the templates you like, and most of your sign-up answers (such as how you identify and your birth year), never the photos, to train GlowSync AI on your style (the Privacy Policy, section 3.13); you can turn it off at any time in Profile › Personalization.
Face-aware editing. Faces are never used for ads, and GlowSync's servers never receive faceprints. GlowSync finds the faces in your photos so you can edit each one; in a shared edit, it receives the photos, where each person's face appears and which face each person picked, so everyone can edit their own face. Style learning keeps the Beauty settings you choose for each face, how many faces a photo shows and roughly how large they are, and, in a shared edit, which face is yours, never a face itself or where it sits.
Content responsibility. You're responsible for making sure you have permission to edit and share photos of other people who appear in them.
Shared edits. In a shared edit, the GlowSync apps of the people editing together do this work, not GlowSync's servers: they find the faces and create the finished photos with everyone's retouching, and each person's app adds their own look to their copy.
Automatic tools can make mistakes. GlowSync may miss a face, find one that isn't there or produce a result you don't like. Check your edits before you save or share them.

6. Acceptable use

We don't tolerate objectionable content or abusive behavior. You agree not to use GlowSync to:

break the law or anyone's rights, including rights to privacy, publicity and intellectual property;
add photos of people who haven't agreed to be in them, or share someone's photos in a way that harms them;
create or share sexual content involving anyone under 18, or sexual or intimate images of anyone without their agreement;
harass, bully, threaten or impersonate anyone, or make edits meant to deceive or humiliate someone;
send invitations to people who don't want them, or misuse invitation links or referral codes, for example by creating accounts to collect rewards;
access other people's accounts or shared edits without permission, or get around a lock or a limit;
interfere with GlowSync or its security, overload it, scrape it or use bots on it;
copy, modify, reverse engineer, sell or rent the app, except where the law allows it; or
get Premium features without paying for them.

7. GlowSync Premium

What it is. GlowSync Premium is an optional subscription that unlocks extra features. What Premium includes, its price and its billing period are shown in the app before you buy. Some features, and how often you can use them, depend on whether you have Premium.
Payment. Payment is charged to your Apple Account when you confirm the purchase. Apple processes all payments.
Automatic renewal. Your subscription renews automatically at the end of each billing period (for example, each week, month or year) at the price then in effect, unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
Free trials. If a free trial is offered, you'll be charged when it ends unless you cancel at least 24 hours before it ends. If you buy a subscription during a free trial, the unused part of the trial ends.
Managing and cancelling. You can manage or cancel your subscription in the Settings app (Settings › your name › Subscriptions) or, while you have a Premium subscription, from Profile › GlowSync Premium › Manage subscription in the app. Deleting the app or your GlowSync account doesn't cancel your subscription.
Price changes. If the price of your subscription goes up, Apple will tell you in advance and, where required, ask for your agreement.
Refunds. Apple handles refunds under its own policies. You can ask Apple for one at reportaproblem.apple.com.
Restoring. If you reinstall GlowSync or use a new iPhone, use Restore purchases on Profile › GlowSync Premium (or the Restore link on the Premium page).
Premium time as a reward. Premium time you receive as a reward or promotion ends when its period ends, has no cash value and can't be transferred.

8. Referral rewards (when we run a referral program)

A referral counts only when a friend who is new to GlowSync enters your referral code or opens your referral link while signing up, or joins a shared edit through your invitation within 30 days of creating their account.
Rewards are Premium time for both the person who referred and the friend, in the amounts shown in the app. They're added once the friend has an account and has finished a shared edit. There's a yearly limit on the rewards one person can earn, shown in the app.
We may hold a reward while we check it. A reward can be reversed if the referral doesn't follow these Terms, or if the friend's account is deleted or their purchase is refunded soon after the reward.
Rewards have no cash value and can't be transferred. We may change or end the program at any time; rewards already added stay unless they are reversed as described above.

9. Our app and your license to use it

GlowSync, including the app, its design, looks, filters and name, belongs to us or our licensors.
We give you a personal, non-exclusive, non-transferable, revocable license to use the GlowSync app on Apple devices you own or control, for your personal, non-commercial use, as the App Store's Usage Rules allow. You can keep and share the finished photos you make.
If you send us ideas or feedback, we may use them freely, without any obligation to you.
To send a notice of claimed copyright infringement, or a counter notice, contact our designated copyright agent as described at https://glowsync.me/dmca.html.

10. Other companies' services

Apple's and Google's sign-in services, the App Store and the apps you share to (such as Messages) are provided by other companies under their own terms. You must follow any terms that apply to them when you use GlowSync, for example your mobile data plan.

11. Changes to GlowSync

We keep improving GlowSync, so features may be added, changed or removed. We may pause or stop GlowSync, or part of it. If we stop GlowSync entirely, we'll give notice in advance where we can, for example on glowsync.me or in an app update, so you can save your photos.

12. Ending these Terms

You can stop using GlowSync at any time and delete your account in the app. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering GlowSync; where reasonable, we'll tell you first. Sections 3 (for shared edits), 13, 14, 15, 16 and 19 continue to apply after these Terms end.

13. Disclaimers

GlowSync is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that GlowSync will be uninterrupted or error-free or that automatic tools will give any particular result. Nothing in these Terms limits rights you have as a consumer that can't be limited by contract.

14. Limitation of liability

To the extent the law allows:

we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and
our total liability for all claims relating to GlowSync is limited to the greater of the amount you paid for GlowSync Premium in the 12 months before the claim arose and USD 50.

These limits don't apply where the law doesn't allow them, including to liability for fraud, for death or personal injury caused by negligence, or for gross negligence or willful misconduct.

15. Indemnity

To the extent the law allows, you agree to cover our reasonable losses and costs from claims by other people that arise from your content or from your breach of these Terms, including claims by people shown in photos you added.

16. Disputes and governing law

Talk to us first. Most concerns can be solved quickly. Write to support@glowsync.me and give us 30 days to try to resolve the matter before starting a legal claim.
Governing law. These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules.
Courts. Subject to the next point, the state and federal courts in San Francisco County, California, have jurisdiction over disputes relating to these Terms.
Your rights as a consumer. If you're a consumer and the law where you live gives you mandatory protections or the right to bring a claim in your local courts, these Terms don't take those away.

17. If you got GlowSync from Apple's App Store

Your use of the app is also subject to Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If it conflicts with these Terms about your license to use the app, Apple's agreement applies. In addition:

These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for GlowSync and its content. Your use of GlowSync must also follow the Usage Rules in the Apple Media Services Terms and Conditions.
Your license to use GlowSync is non-transferable and limited to using it on Apple-branded products that you own or control, as permitted by those Usage Rules; the app may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where the App Store allows it.
We are solely responsible for any maintenance and support for GlowSync. Apple has no obligation whatsoever to furnish any maintenance and support services for GlowSync.
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If GlowSync fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for GlowSync to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to GlowSync, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims by you or any third party relating to GlowSync or your possession and use of it, including (i) product liability claims; (ii) any claim that GlowSync fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
If a third party claims that GlowSync or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using GlowSync, for example your wireless data service agreement.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

18. Changes to these Terms

We may update these Terms. When we do, we change the date at the top, and if a change matters, we'll give notice before it takes effect, for example in an app update or on this page. If you keep using GlowSync after a change takes effect, the updated Terms apply. If you don't agree, stop using GlowSync and delete your account. Changes don't apply to disputes that arose before them.

19. General

These Terms, together with the Privacy Policy, are the whole agreement between you and us about GlowSync.
If part of these Terms can't be enforced, the rest still applies. If we don't enforce a part right away, we don't give up our right to enforce it later.
We may transfer these Terms to a company that takes over GlowSync. You may not transfer them.
If we provide a translation of these Terms, the English version applies if the two differ, unless the law where you live requires otherwise.
We may give you notices on glowsync.me or in the app, for example in an app update. You can send us notices at support@glowsync.me.
